The Liquidator has brought a section 423 IA 1986 claim against the respondents in this case. On behalf of those respondents that he represents, Setu Kamal made a strikeout application in 2020 which was successful and the Liquidator was ordered to amend its claim. Following the amendment of the claim, the respondents then produced their points of defence in 2021. In light of points raised in the defence, the Liquidator then applied to the court to amend their claim. Following a four day hearing, this was refused by the High Court. The decision is attached.
