This case concerned practice and procedure relating to a service of a claim form. The claimant had served the claim form outside the jurisdiction but had failed to file or serve a notice of entitlement to serve the claim form out of the jurisdiction. As a result, the claim form had not been validly served within the required time. The issue was whether the claimant should apply for an extension of time for serving the claim form, relief from sanctions, or permission to serve the claim form without filing the required notice.
